Under British Columbia’s Family Law Act, spouses are generally entitled to an equal share of family property and are equally responsible for family debt, regardless of who holds title. Property one spouse brought into the relationship, and certain gifts and inheritances, may be treated as excluded property, although any increase in their value during the relationship can be divisible. How these rules apply depends on your specific circumstances, so it is best to get tailored legal advice.

Whether spousal support is payable depends on factors such as the length of the relationship, the roles each spouse played, and the financial means and needs of each person. Where there is entitlement, courts and lawyers commonly use the Spousal Support Advisory Guidelines to estimate an appropriate range for the amount and duration. Because these are guidelines rather than fixed rules, outcomes vary case by case.

Child support is primarily based on the Federal Child Support Guidelines: the paying parent’s income and the number of children generally set the base monthly amount. On top of that base, parents typically share special or extraordinary expenses (often called “section 7” expenses) such as childcare, medical and dental costs, or post-secondary education in proportion to their incomes. Shared or split parenting arrangements can change how the numbers work. Child support is the right of the child, so it generally cannot be bargained away.
