Family Law Costs & Timelines in British Columbia
Every family law matter is different. The ranges below are general guidance for British Columbia — your actual cost and timeline depend on how complex your case is, how much you and the other party agree on, and court availability.
| Family law matter | How fees typically work | Typical timeline |
|---|---|---|
| Initial consultation | A booked appointment to review your situation and next steps | 30–60 minutes |
| Uncontested (joint) divorce | Often a fixed or limited fee once both spouses agree on all terms | About 4–6 months after filing, subject to court processing |
| Contested divorce | Billed hourly against an upfront retainer that is drawn down as work is done | 1–2+ years, depending on the issues and court availability |
| Child custody & parenting arrangements | Hourly against a retainer | Weeks to a few months if negotiated; longer if litigated |
| Child & spousal support | Hourly; simpler calculations are typically more limited in scope | Weeks to months |
| Separation, cohabitation & prenuptial agreements | Often a fixed or capped fee | A few weeks, depending on negotiation |
| Property & asset division | Hourly against a retainer | Several months; longer when contested |

FAQs
Do I need to go to court?
Not always. Many family matters can be resolved through
negotiation or agreements, but we are prepared to litigate when necessary.
How long does a divorce take?
It depends on whether the issues are contested. Uncontested divorces move quickly; contested matters take longer due to evidence, negotiations, or court steps.
What should I bring to my consultation?
Any existing agreements, financial information, and court
documents. If you don’t have them yet, we’ll guide you through what’s needed.
Can you help if my situation is urgent?
Yes. We handle emergency protection orders, urgent parenting disputes, and immediate safety concerns.
How much does a family lawyer cost in BC?
Family lawyers in BC typically charge an hourly rate and ask for an upfront retainer that is drawn down as work is done; some discrete services may be offered at a flat fee. Total cost depends on how contested the matter is and whether it settles or proceeds to court. At Adam Soliman Law Corporation we discuss fees and likely cost ranges with you at the outset so there are no surprises. Contact us at (778) 374-6078 to discuss your matter.
How is property divided when you separate in BC?
Under British Columbia’s Family Law Act, spouses are generally entitled to an equal share of family property and are equally responsible for family debt, regardless of who holds title. Property one spouse brought into the relationship, and certain gifts and inheritances, may be treated as excluded property, although any increase in their value during the relationship can be divisible. How these rules apply depends on your specific circumstances, so it is best to get tailored legal advice.
How is spousal support decided in BC?
Whether spousal support is payable depends on factors such as the length of the relationship, the roles each spouse played, and the financial means and needs of each person. Where there is entitlement, courts and lawyers commonly use the Spousal Support Advisory Guidelines to estimate an appropriate range for the amount and duration. Because these are guidelines rather than fixed rules, outcomes vary case by case.
How is child support calculated in BC?
Child support is primarily based on the Federal Child Support Guidelines: the paying parent’s income and the number of children generally set the base monthly amount. On top of that base, parents typically share special or extraordinary expenses (often called “section 7” expenses) such as childcare, medical and dental costs, or post-secondary education in proportion to their incomes. Shared or split parenting arrangements can change how the numbers work. Child support is the right of the child, so it generally cannot be bargained away.
